Showik files fresh bail application

Rhea Chakraborty’s brother Showik Chakraborty, has reportedly filed a fresh bail application in the Special NDPS Court, almost a month after the Bombay High Court rejected his bail plea.
According to the latest reports, Showick, who remained in custody in the Narcotics Control Bureau’s drug case that emerged from the Sushant Sing Rajput death case, has sought bail again citing a recent Supreme Court ruling.

In light of the Supreme Court’s ruling last month, which held that statements made before NCB officers cannot be considered as “confessions”, Showik’s legal counsel has cited that there is no reason to keep the 24-year-old behind bars.
Since his arrest on 4 September he has been denied bail by the special court and the Bombay High Court.

Reports state that Chakraborty’s lawyer, Satish Maneshinde has also pointed out that no drug was recovered from his client’s possession and that the NCB’s only evidence was the statements of the co-accused.

The plea stated that Showik’s statements cannot now be used as “evidence” after the SC ruled that NCB officers are to be considered as “police officers”. Reports further went on to state that all statements recorded by the NCB, under Section 67 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act cannot be considered confessions.

The NCB has however, claimed that there is sufficient digital records to prove the involvement of the accused in the case.
